2. Purpose and Collection of Data

Mediator Mag. Marc Kappl (Finkengasse 6, 8020 Graz) will only collect, process, and use your personal data with your permission or if it is necessary for the purposes of mediation in accordance with the law. This is always performed in accordance with the GDPR and national civil law requirements. Only the data necessary to provide and complete the services offered, or that which you have provided yourself, will be compiled.

  • Art. 6(1)(b) GDPR: Performance of a contract.
  • Art. 6(1)(c) GDPR and § 17(3) ÖstZivMediatG: Legal obligations.

3. Disclosure and Eradication

As a concerned party, you have the right at any time to obtain information about your personal data, its origin and recipients, and the purpose of data processing—provided that the mediator’s confidentiality is observed. You also have the right to:

  • Correction and data transfer.
  • Revocation and objection.
  • Restriction of processing.
  • Blocking or deletion of incorrect or inadmissibly processed data.

If there are any changes to your personal data relevant to the mediation process, please disclose them to the mediator. Requests for information, deletion, or correction can be sent to the contact address provided at the end of this declaration.

If you believe the processing of your data violates data protection laws, you may lodge a complaint with the competent supervisory authority:

  • Austria: Austrian Data Protection Authority (Datenschutzbehörde).
  • Slovenia: Information Commissioner of the Republic of Slovenia.

4. Data Protection

Your personal data is protected by appropriate organizational and technical measures against unauthorized, unlawful, or accidental access, loss, or manipulation. Despite our efforts to maintain a high standard of care, it cannot be ruled out that information disclosed via the internet may be viewed by third parties.

Please note: MK-Mediation accepts no liability for the disclosure of information due to errors in data transmission or unauthorized access by third parties (e.g., hacking of email accounts or interception of faxes), unless these are directly caused by MK-Mediation.

5. Storage of Data

Data will not be stored for longer than is legally required or necessary for the fulfillment of service requirements and the cooling-off periods of potential legal claims.
